Terms of Service
Welcome to the legal research platform provided by AequiLex Legal Technology Limited ("we", "us", or "our"). Before registering or using this service, you must read the following terms carefully. Your use of the service indicates that you have read and agreed to these Terms.
1. Service Definition & Scope
AequiLex is a legal research assistive tool based on artificial intelligence (AI) technology, focusing on Hong Kong case law.
- Core Functions: Retrieval, analysis, and summarization of public judgments from Hong Kong courts, and preliminary contract review.
- Nature of Service: This service is solely a research and development and assistive tool. The system is trained on public judgments and ordinances of the Hong Kong government.
- Authority Warning: Case summaries, paragraphs, or AI summaries provided on the platform are for reference only. For complete and legally authoritative judgments, users must refer to official judiciary records or relevant legal reports (such as HKLII or official government gazettes).
2. Professional Due Diligence
2.1 Verification Obligation: Users (especially legal practitioners, researchers, and students) expressly agree that this service serves only as a preliminary research aid. Users have the absolute responsibility to verify the accuracy, completeness, and timeliness of AI outputs through official channels before acting upon them.
2.2 Decision Risk: Any risks associated with legal actions taken, court documents submitted, or business decisions made in reliance on information from this service are entirely borne by the user.
3. Disclaimer
- Non-Lawyer Service: The content on this website is AI-generated and is not written by practicing solicitors or barristers in Hong Kong. Using this service does not constitute any lawyer-client relationship.
- Limitations of AI: Due to the probabilistic nature of AI technology, outputs may contain biases, omissions, or errors. Users bear the ultimate responsibility for independently verifying the accuracy of all outputs.
- Assumption of Risk: We shall not be liable for any consequences or losses arising from legal actions taken by users in reliance on information from this platform.
4. Subscriptions, Billing & Trials
- Trial Offers: Each independent entity (individual or organization) is limited to registering one account to obtain initial computing credit offers. Abusing trial resources through malicious means (e.g., temporary emails, multiple identities) is strictly prohibited. We reserve the right to pursue legal action.
- Auto-Renewal: Unless canceled 24 hours before the end of the billing cycle, the system will assume automatic renewal.
- No Refunds: Due to the immediate nature of digital services, all paid fees (including but not limited to monthly fees, annual fees, and unused credits) are non-refundable.
5. Intellectual Property
- Original Documents: The copyright of original texts such as judgments and statutory provisions accessed via this service belongs to the Government of the Hong Kong Special Administrative Region or their original copyright owners.
- AequiLex Assets: Data structures processed by our technology, AI-generated summaries, interface designs, and algorithmic logic are the exclusive intellectual property of AequiLex.
- Third-Party Sources: The platform may provide links to external databases (e.g., HKLII). We do not own the copyright of such external websites, nor do we control their content.
6. User Conduct & AI Usage Limits
Users must comply with the following restrictions when using AI functions:
- No Reverse Engineering: You may not use the outputs of this platform to train, fine-tune, or develop any AI model that competes with AequiLex.
- No Mass Scraping: The use of automated tools (such as scrapers) to extract large volumes of AI summary data from this platform for commercial redistribution is strictly prohibited.
- No Claim of Ownership: Users may not claim the legal analysis generated by this platform as their own entirely independent creation without manual verification.
7. Data Processing & Privacy
- Third-Party Providers: This service utilizes third-party AI APIs (such as Google Gemini). Search queries entered by users are sent to these providers for real-time processing.
- Confidentiality Warning: Given the AI processing model, please DO NOT input any sensitive information involving client privacy, trade secrets, or information protected by Legal Professional Privilege.
8. Limitation of Liability
8.1 Liability Cap: To the maximum extent permitted by Hong Kong law, our total aggregate liability for any user claims (whether based on breach of contract, tort, negligence, or other legal theories) shall not exceed the total amount actually paid by the user for the service in the three months preceding the claim, or HK$500 (whichever is higher).
8.2 Exclusions: We absolutely bear no liability for any of the following:
- Lost lawsuits, fines, or damages resulting from erroneous reliance on AI information;
- Indirect damages, consequential damages, loss of profits, loss of goodwill, or loss of data;
- Losses caused by the content of third-party external linked websites.
9. Indemnification
9.1 Reverse Indemnification: If a user's breach of these Terms or improper use of the service results in any third party bringing a claim or legal action against us, the user agrees to indemnify us and our officers for all related expenses (including legal fees, fines, and settlement amounts).
10. Termination & Blocking
10.1 Anomaly Monitoring: If we detect abnormal traffic, suspected data scraping, or behaviors that violate the AI usage guidelines, we reserve the right to permanently block the account immediately without prior notice and without any compensation.
11. Governing Law & Dispute Resolution
11.1 Jurisdiction: These Terms are governed by the laws of the Hong Kong Special Administrative Region.
11.2 Mediation First: Any disputes arising from these Terms must first undergo administrative mediation. If mediation fails, it shall be submitted to the exclusive jurisdiction of the Hong Kong courts.
